1. Overview

EventShareCloud respects the intellectual property rights of others and expects its users to do the same. This Copyright & DMCA Policy describes how we handle copyright infringement claims in accordance with the Digital Millennium Copyright Act ("DMCA") and applicable Turkish intellectual property laws (Law No. 5846 on Intellectual and Artistic Works). If you believe that content hosted on EventShareCloud infringes your copyright, please follow the procedures outlined below.

2. Reporting Copyright Infringement (DMCA Takedown Notice)

If you are a copyright owner or authorized to act on behalf of one, you may submit a DMCA takedown notice by sending an email to our Designated Agent at [email protected] with the following information: 1. A physical or electronic signature of the copyright owner or authorized representative. 2. Identification of the copyrighted work claimed to have been infringed. 3. Identification of the infringing material and information sufficient for us to locate it (e.g., event name, photo URL, or screenshot). 4. Your contact information, including name, address, telephone number, and email address. 5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law. 6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner. Please use the subject line "DMCA Takedown Notice" when submitting your request.

3. Processing of Takedown Notices

Upon receipt of a valid DMCA takedown notice, EventShareCloud will: - Promptly remove or disable access to the allegedly infringing content. - Notify the user who uploaded the content (if identifiable) that the content has been removed. - Provide the uploader with information about how to submit a counter-notification. We aim to process all valid takedown requests within 2 business days of receipt.

4. Counter-Notification

If you believe that your content was removed in error or that you have the right to use the material, you may submit a counter-notification to [email protected] containing: 1. Your physical or electronic signature. 2. Identification of the material that was removed and the location where it appeared before removal. 3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification. 4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts of Istanbul, Turkey, and that you will accept service of process from the person who provided the original notification. Upon receipt of a valid counter-notification, EventShareCloud will forward it to the original complainant. If the complainant does not file a court action within 10 business days, EventShareCloud may restore the removed content.

5. Repeat Infringer Policy

EventShareCloud maintains a policy for the termination of accounts of users who are repeat infringers. Users who repeatedly upload copyrighted content without authorization will have their accounts suspended or permanently terminated at EventShareCloud's sole discretion. For the purposes of this policy, a "repeat infringer" is any user against whom EventShareCloud has received more than two valid DMCA takedown notices.

6. Safe Harbor

EventShareCloud operates as a service provider under Section 512 of the DMCA. We do not monitor or pre-screen user-uploaded content. By complying with the DMCA's notice-and-takedown procedures, EventShareCloud qualifies for safe harbor protection from liability for user-uploaded infringing content. EventShareCloud does not endorse, verify, or assume responsibility for user-generated content.

7. Event Organizer Responsibilities

Event organizers are responsible for the content uploaded to their events by guests. Organizers may moderate and remove any content from their events at any time using the event management tools provided. If an organizer becomes aware of potentially infringing content in their event, they should remove it promptly or report it to us at [email protected].

9. Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorney fees. Please ensure that your takedown notice or counter-notification is accurate before submission.
